1. HOW TO PLACE AN ORDER:

A. To process your order for In-Stock merchandise, we require payment in full at the time of your purchase. To process your order for out of stock merchandise Special Orders, we require a 25% deposit at the time of your purchase.

B. We accept cash, personal checks, bank checks, cashiers checks, money orders, Mastercard, Visa and Discover. We have a 3 % processing fee added to all credit card orders.

C)All orders are double checked by our staff. In case of a pricing error, math error or a misquote you will be notified. If you do not approve the correction and agree to pay the corrected sales price, we reserve the right to cancel the sale.

2. DELIVERY

A. In most cases, you will receive in-stock items within 2 to 6 weeks and special orders within 5 to 11 weeks of your purchase. These time periods are only estimates based upon past experience. We are not responsible for manufacturer delays or changes in shipping dates. All shipments are made FOB Seller's Loading Dock.

B. Most Deliveries will be made thru an in-home delivery service and a representative of the delivery service will contact you to arrange delivery. They usually contact you 2- 7 days in advance of delivery to schedule a day & time with you. If you are unable to accept delivery at the scheduled time, you will be given a call on the next scheduled trip which is usually 30 days later.

Please note that we do not schedule the deliveries. The deliveries are scheduled by a contracted delivery specialist. Shipping costs are paid directly to them. The exact amount and method of payment will be confirmed with you by the delivery company.

C. You are responsible for notifying us in advance of any special delivery conditions, Please pay attention to the size of the merchandise and ensure it will fit through any and all passages. Example: doorways, stairways, corridors, elevators, overhangs & etc. LINDYS FURNITURE OR BETTER HOMES FURNITURE will not be liable for any damages that might result from attempting delivery. If delivery to your desired area is not reasonably accessible, delivery will be made to most accessible area as determined by the delivery personnel. In advance of delivery, you are responsible to have a clear path and area ready for placement of your furniture. The delivery service will not hang any items. If more than two delivery people are needed due to the size or weight of an item, you are responsible to provide additional personnel. In some cases, a delivery may be subject to special transportation or toll charges to access your property. All additional charges are your responsibility. In the event that the delivery location is not accessible by the carrier's vehicles, the delivery will be made to the nearest accessible point and you will be responsible for delivery from that point.

D. In the event that no one is present to accept a scheduled delivery or you refuse a scheduled delivery, you will be subject to a redelivery charge.
3. DAMAGES

At the time of delivery, please thoroughly inspect each item. In the event an item appears to be defective or damaged, please notify the delivery personnel immediately. If possible, they will correct the problem. If the problem can not be fixed note it on the bill of lading. You will need to return it with the delivery personnel. Once it arrives back to the delivery service, it will be inspected. At the delivery services discretion, the item will be deluxed, repaired to 100% factory standards or replaced and redelivered to you. There will be no additional delivery cost to you unless the piece met manufacturer quality standards.

4. LIMITED WARRANTY

A. We warrant the merchandise included in this contract against manufacturer defect for a one year period. Warranty begins when we receive the merchandise. We will repair or replace, at manufacturer discretion, any defective merchandise. Defects caused by abuse or negligence are not covered.

B. This warranty is based on proof of purchase and applies to original purchaser only.

C. We do not warrant the wearability, color-fastness, stretching or shrinking of furniture. Colors may vary due to dye lot variations between sample swatches and the final product, therefore we assume no responsibility for variations.

D. There is no manufacturer warranty offered on closeout or overstock product. LINDY’S FURNITURE guarantees that any closeout or AS IS product that is purchased will ship from our facility in the condition as stated on our website.

E. We do not warrant color and grain variations in wood and leather. Additionally, the inherent characteristics of fine woods affect how they absorb stains. As a result, we cannot ensure the matching of related pieces or various surface stains on the same item.

F) Stone, marble, and granite are natural products. You should expect inconsistencies in color and grain. Fillers are often used to enhance the surface beauty. These characteristics are within industry standards and are acceptable and we make no warranty with respect thereto.

G) Glass, mirrors and metal finishes may be subject to small seeds, slight areas of discoloration, minor surface or subsurface scratches. Inconsistent weld points are inevitable in furniture hand crafted of metal. These characteristics are within industry standards and are acceptable and we make no warranty with respect thereto.

H) No change of these Conditions of Sale, either expressed or implied, shall be valid unless documented and approved by our management in writing.
